Your sole and exclusive remedy for dissatisfaction with the Service is to stop using kinetly.xyz.

We make no warranty that (i) the Service will meet your requirements or expectations, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Service will be accurate, reliable, or complete, or (iv) the quality of any products, services, information, or other material obtained by you through the Service will meet your expectations.

7. Indemnification

You agree to defend, indemnify, and hold harmless kinetly.xyz and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account; b) a breach of these Terms, or c) User Content posted on the Service.

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

We also reserve the right to discontinue the Service or any part thereof at any time, with or without notice.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in Denver, Colorado for the purpose of litigating any dispute arising from or related to these Terms or your use of kinetly.xyz.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
